Terms of Service

1. Agreement to Terms

By downloading, installing, accessing, or using Pure Path ("the App"), you agree to be bound by these Terms of Service ("Terms"), which serve as the End User License Agreement (EULA) for the App. If you do not agree to these Terms, do not download, install, or use the App.

The App is operated by Ihsan Studio inc., a Canadian federal corporation incorporated in Quebec under the Canada Business Corporations Act, with its registered office in the Province of Quebec, Canada ("we," "us," "our," or "the Company").

These Terms apply to all users of the App, including users who access the App through the Apple App Store, Google Play Store, or the web.

2. License Grant and Scope

Subject to your compliance with these Terms, Ihsan Studio inc. grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on devices that you own or control, solely for your personal, non-commercial use.

You may not:

• Copy, modify, distribute, sell, lease, sublicense, or reverse-engineer the App or any portion of it
• Remove, alter, or obscure any copyright, trademark, or other proprietary notices
• Use the App for any commercial purpose or on behalf of any third party
• Attempt to gain unauthorized access to our servers, systems, or other users' accounts
• Use the App to develop a competing product or service
• Use automated systems (bots, scrapers, crawlers) to access or interact with the App

3. Description of Service

Pure Path is a mobile application designed to help Muslims recover from harmful habits using evidence-based psychological techniques (including Cognitive Behavioral Therapy, Acceptance and Commitment Therapy, Dialectical Behavior Therapy, and Motivational Interviewing) combined with Islamic spiritual practices. The App provides:

• A 90-day brain rewiring recovery program with streak tracking and milestones
• An AI-powered recovery coach (Rafiq) using Google Gemini
• Emergency Protocol, a multi-phase urge intervention system
• Anonymous, gender-segregated community features (forums, chat, clans, friends)
• Content blocking session management with accountability features
• Distraction games and recovery resources
• Private journaling, mood tracking, and breathing exercises
• Islamic recovery content, duas, dhikr, and soundscapes
• Advanced privacy features (app lock, stealth disguise modes, panic PIN)

4. Medical and Professional Disclaimer

• The CBT, ACT, DBT, and other therapeutic techniques in the App are for educational and self-improvement purposes only.
• The AI Coach (Rafiq) is an AI-powered tool, not a licensed therapist, psychologist, counselor, psychiatrist, or medical professional.
• The Islamic guidance provided in the App is for spiritual support purposes. The AI Coach is not an Islamic scholar, mufti, or qualified religious authority. Islamic content should not be taken as formal religious rulings (fatawa).
• The content blocking features are best-effort tools designed to assist users in managing their digital environment. They do not guarantee complete content restriction and should not be relied upon as the sole method of content filtering.
• Ihsan Studio inc. makes no representations or warranties regarding the effectiveness of any recovery techniques, interventions, or features provided in the App.

5. Eligibility and Age Restrictions

You must be at least 13 years of age to use Pure Path. If you are under 13, you may not use the App under any circumstances.

If you are between 13 and 18 years of age (or the age of majority in your jurisdiction), you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

In the EEA, users between 13 and 16 require verifiable parental consent in accordance with Article 8 of the GDPR.

6. User Accounts

The App uses anonymous user accounts identified by unique user IDs. No email, real name, or personally identifiable information is required to create an account. You are responsible for:

• Maintaining the security of your device, PIN, and recovery code
• All activity that occurs under your account
• Safeguarding your recovery code, as account restoration is impossible without it since we store no identifying information

You agree to use the App only for its intended purpose of recovery, self-improvement, and spiritual growth.

7. Subscriptions and Payments

7.1 Subscription Terms

Pure Path offers a premium subscription ("Pure Path Premium") available through the Apple App Store and Google Play Store. By subscribing, you agree to the following:

• Subscriptions automatically renew at the end of each billing period (monthly) unless cancelled at least 24 hours before the end of the current period
• Your Apple ID or Google Play account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscription at any time through your Apple App Store or Google Play Store account settings
• All payments are processed exclusively through Apple's App Store or Google Play Store. We do not collect or store payment card information

7.2 Free Trial

Pure Path may offer a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged.

7.3 Refunds

Refunds are handled exclusively by Apple (for App Store purchases) or Google (for Google Play purchases) in accordance with their respective refund policies. Ihsan Studio inc. does not process refunds directly. To request a refund:

7.4 Amanah (Hardship) Access

Pure Path offers an honor-system hardship access program called "Amanah" (Arabic: sacred trust) for users who genuinely cannot afford the subscription. By activating Amanah Access, you affirm on your honor that you are experiencing genuine financial hardship and cannot afford the subscription at this time. Amanah Access grants full premium features at no cost.

Ihsan Studio inc. reserves the right to modify or discontinue the Amanah Access program at any time. Abuse of the Amanah Access system may result in account suspension.

8. Community Guidelines and User-Generated Content

8.1 Acceptable Use

When using community features (forums, chat, clans, friends), you agree to:

• Maintain respectful, supportive, and encouraging interactions
• Respect the gender-segregated nature of community spaces
• Not share personally identifiable information about yourself or others
• Not post triggering, explicit, sexually suggestive, or inappropriate content
• Not harass, bully, threaten, or intimidate other users
• Not promote products, services, external platforms, or solicitations
• Not post hate speech, discriminatory content, or content inciting violence
• Not attempt to identify, dox, or expose other anonymous community members
• Not circumvent content filters or moderation systems
• Report any content that violates these guidelines

8.2 Zero Tolerance Policy

8.3 Content Moderation

All user-generated content is subject to automated and manual review. We reserve the right to:

• Remove any content that violates these guidelines without prior notice
• Suspend or permanently ban users who violate community standards
• Automatically flag users who accumulate 5 or more valid content reports for administrator review
• Take action on reported content within 24 hours of receiving a valid report
• Cooperate with law enforcement when content poses a threat to safety
• Escalate automatically for immediate review any user who receives reports from 3 or more unique users within 24 hours
• Detect and flag accounts that appear to be re-created after a permanent ban, using device fingerprint matching

8.4 Community Trust Level System

Pure Path uses an activity-based trust level system (Levels 0-3) to onboard new community members gradually and protect existing members from potential bad actors. Trust is earned through positive community participation, not simply by passage of time.

• Level 0 (New member): Can read and post in community forums and join up to 2 clans. Cannot send direct messages to non-friends. Cannot send friend requests (can accept them). This is the default level for all new accounts.
• Level 1 (5 trust points): Can send up to 3 friend requests per day and join up to 3 clans.
• Level 2 (15 trust points): Full community access, including unlimited friend requests (up to 10/day) and unlimited clans.
• Level 3 (50 trust points + 14 days on platform): Fully trusted member with no community restrictions.

Trust points are earned by: making your first community post (+3), receiving a like on your content (+1 per like), joining a clan (+2), completing a 3-day consecutive Niyyah streak (+3), and returning to the app after 7 days of absence (+5). Trust levels never decrease once earned.

Verified Ambassadors are exempt from all trust level restrictions.

8.5 Automated Safety Systems

• Crisis Detection: All posts and direct messages are scanned for crisis language (e.g., suicidal ideation, self-harm language) to enable compassionate outreach. Content is never blocked; detection is silent and confidential.
• AI DM Safety Screening: When an adult user (18+) contacts their third unique minor (13-15) within 7 days, the first 10 messages from each of those 3 conversations are analyzed by AI for signs of grooming or predatory behavior. This threshold-triggered scan is not mass surveillance; it targets a specific behavioral pattern associated with grooming. Full details are in our Privacy Policy (Section 12.2).
• Report Escalation: Receiving reports from 3 or more unique users within 24 hours triggers an automatic priority escalation for administrator review.
• Ban Evasion Detection: The device identifier associated with your app installation is compared against identifiers linked to permanently banned accounts. A match creates an administrator review flag; no automated enforcement occurs.

8.6 Minor-Specific Restrictions

Users whose stated age is 13-15 are subject to additional automatic protective measures:

• They are excluded from community search results for users who are not their confirmed friends or in the same clan (Ghost Mode)
• They cannot receive direct messages from accounts created within the past 3 days
• Interactions with adult users may be subject to automated AI safety screening (Section 8.5)

8.7 Reporting and Blocking

Users may report objectionable content or block other users at any time through the App. Reports are reviewed promptly and appropriate action is taken. Blocking a user prevents all mutual content visibility and interaction.

8.8 Content License

By posting content to the community features, you grant Ihsan Studio inc. a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute your content solely within the App and for moderation purposes. You retain ownership of your content and may delete it at any time.

9. Intellectual Property

All content, features, functionality, software, designs, graphics, logos, icons, images, audio recordings, and text of Pure Path are the property of Ihsan Studio inc. and are protected by Canadian and international copyright, trademark, patent, trade secret, and other intellectual property laws.

Quranic verses, Hadith, traditional Islamic prayers (duas), and dhikr included in the App are from the public Islamic scholarly tradition and are presented for educational and spiritual purposes.

"Pure Path," the Pure Path logo, and related marks are trademarks of Ihsan Studio inc.

10. Privacy

Your use of the App is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your information. The Privacy Policy is incorporated into these Terms by reference.

11. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

Ihsan Studio inc. does not warrant that:

• The App will meet your specific recovery needs or expectations
• The App will be uninterrupted, timely, secure, or error-free
• The results obtained from using the App will be accurate or reliable
• Any defects or errors in the App will be corrected
• The AI Coach will provide accurate, complete, or appropriate guidance in all circumstances
• The content blocking features will successfully block all harmful content

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL IHSAN STUDIO INC., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use or inability to use the App
• Any reliance on information, guidance, or content provided through the App, including AI-generated content
• Any failure of the content blocking features to prevent access to harmful content
• Unauthorized access to or alteration of your data
• Any third-party conduct or content within the community features
• Any interruption, suspension, or termination of the App

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE APP SHALL NOT EXCEED THE AMOUNT YOU PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR FIFTY CANADIAN DOLLARS (CAD $50.00), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.

13. Indemnification

You agree to indemnify, defend, and hold harmless Ihsan Studio inc., its directors, officers, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

• Your use of the App
• Your violation of these Terms
• Your violation of any rights of any third party
• Any content you submit, post, or transmit through the App

14. Termination

We may terminate or suspend your access to the App at any time, with or without prior notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable. Upon termination:

• Your license to use the App is immediately revoked
• We may delete your account and all associated data
• Sections 9, 11, 12, 13, 15, and 16 of these Terms shall survive termination

You may terminate your account at any time by deleting your account through the App settings or by contacting support@ppath.app.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Province of Quebec and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved as follows:

• Informal Resolution: Before initiating any formal proceedings, you agree to first contact us at support@ppath.app and attempt to resolve the dispute informally for at least 30 days.
• Jurisdiction: If informal resolution fails, any legal proceedings shall be brought exclusively in the courts of competent jurisdiction in the judicial district of Montreal, Province of Quebec, Canada. You consent to the personal jurisdiction of such courts.

Nothing in this section prevents either party from seeking injunctive or other equitable relief in any court of competent jurisdiction.

16. Apple App Store Additional Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and Ihsan Studio inc. only, and not with Apple Inc. ("Apple"). Apple is not responsible for the App or its content.
• The license granted to you is limited to a non-transferable license to use the App on any Apple-branded device that you own or control, as permitted by the App Store Terms of Service.
• Maintenance and Support: Ihsan Studio inc. is solely responsible for providing maintenance and support services for the App. Apple has no obligation to provide any maintenance or support.
• Warranty: Ihsan Studio inc. is solely responsible for any product warranties, whether express or implied by law. In the event of any failure to conform to an applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App.
• Product Claims: Ihsan Studio inc., not Apple, is responsible for addressing any claims relating to the App, including but not limited to product liability claims, claims that the App fails to conform to any applicable legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
• Intellectual Property: In the event of any third-party claim that the App infringes a third party's intellectual property rights, Ihsan Studio inc., not Apple, is solely responsible for the investigation, defense, settlement, and discharge of any such claim.
• Legal Compliance: You represent and warrant that (a) you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and (b) you are not listed on any U.S. Government list of prohibited or restricted parties.
• Third-Party Beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

17. Google Play Store Additional Terms

If you downloaded the App from the Google Play Store, the following additional terms apply:

• These Terms are between you and Ihsan Studio inc. only, and not with Google LLC ("Google"). Google is not responsible for the App or its content.
• Your use of the App is also subject to the Google Play Terms of Service.
• Ihsan Studio inc. is solely responsible for the App, its content, maintenance, support, and any warranty or claims related thereto.
• Google is a third-party beneficiary of these Terms and may enforce them against you.

18. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. For material changes that affect your rights, we will make reasonable efforts to notify you through the App.

Your continued use of the App after any modifications constitutes acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the App and delete your account.

19. Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Ihsan Studio inc. regarding the App and supersede all prior agreements, understandings, and communications, whether written or oral.

21. Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. Ihsan Studio inc. may assign these Terms without restriction.

22. Waiver

No waiver of any provision of these Terms shall be deemed a further or continuing waiver of such provision or any other provision. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.
